# API Usage Policy - E-goi # Last Updated: 2025-11-07 # Status: Active # Scope: All integrations using E-goi API v2/v3. 1. Introduction By accessing E-goi's APIs, the Client agrees to this API Usage Policy, as well as the Terms of Use and any other associated policies (all of which are attached to this Agreement). E-goi provides open APIs, access to which is available here. The APIs are intended for the benefit of Clients, externally creating software, services, or modules that connect to the E-goi Service or have access to the E-goi Service data via E-goi APIs (an “Integration”). The main terms used in this document are defined and explained in detail in the Glossary (attached to this contract). It is recommended to consult it for a better understanding of the concepts and definitions applied here. 2. Access The Client will only have access to E-goi APIs with an API key. If the Client creates an Integration with E-goi, the people who use the Client's Integration must have the option to access via the API key. The Client will not ask such people to provide, if applicable, the “login” or password they use to access the E-goi Service. 3. Permitted Use The Client will not use the API to send spam or perform any action that violates the Terms of Use (attached to this Agreement). It will comply with all applicable laws (including privacy laws and export regulations and financial sanctions). It will follow all documentation that E-goi provides for the APIs. It will not attempt to hack, dismantle, or alter the operation of the Service. E-goi may limit the Client's use of the APIs at any time and may monitor the Client's use of the APIs for compliance with these rules. E-goi may deny the Client access to the API if the Client violates this Policy. 4. Privacy The Client will respect the privacy of other E-goi Clients using the Integration. It must obtain the Client's express permission before the Integration connects to the Client's account through the E-goi API. The Integration must present a privacy policy specifying the data that will be collected in the use of the Integration. The Client may only have access to this data as permitted and explained in the Client's privacy policy. The Client must immediately delete the collected data if deletion is requested. Any data collected by E-goi through the Client's Integration will be treated in accordance with the Data Processing Agreement (attached to this Agreement). 5. Integration Security The Client is responsible for implementing and maintaining adequate technical and organisational security measures to protect and preserve the security, integrity, and confidentiality of the data collected by its Integration. These measures must prevent unauthorised access or disclosure of personal or confidential data processed, as well as intentional or unintentional abusive access from the Integration or Service. In case of a security incident, the Client must: Notify E-goi immediately after detecting the incident or failure that may affect or compromise Clients, the API, or the E-goi Service. Promptly collaborate with E-goi to mitigate the impact of the incident, fix the failure, and prevent recurrence. Implement corrective actions and certify in writing that it is in compliance after remediation. E-goi is not responsible for security failures or direct or indirect damage resulting from the Client's Integration that arise from non-compliance with the measures required in this Policy. However, E-goi will work with the client to mitigate damage and losses that such a failure has caused to E-goi or E-goi Clients. Additionally, E-goi reserves the right to: Review or audit the books, documents, agreements, accesses, third-party audit reports, systems, networks, facilities (including physical and remote access to data centers and cloud facilities), controls, policies, and procedures related to the Client's Integration to ensure compliance. Request immediate corrective actions for any security failures or deficiencies identified. The specific responsibilities and rights of both parties concerning incident response and risk mitigation are detailed in the Security Policy (attached to this Agreement). 6. License E-goi grants the Client a non-exclusive, non-transferable, non-sublicensable, revocable, and limited right to access and use E-goi APIs to develop, test, and support its Integration and to distribute or allow access to its Integration to other Clients using the Client's service, provided it complies with this Policy and all applicable laws. The Client has no right to distribute or allow access to E-goi APIs independently. E-goi may terminate the Client's access to E-goi APIs at any time and for any reason. 7. Ownership E-goi owns all rights, titles, and interests in the Service and APIs, including all intellectual property rights, trademarks, code, and features. The Client will not infringe, reverse engineer, or copy E-goi's code, design, or content. It will not use E-goi APIs to compete with the E-goi Service. Any rights not expressly granted by this Policy are retained. Consequently, any right not listed in this Policy is not a right granted to the Client. The Client owns all rights, titles, and interests in the Integration, except for the APIs, trademarks, and the E-goi Service. If the Client provides feedback on the APIs or the Service, E-goi may copy, modify, create derivative works, display, disclose, distribute, or use that feedback without any obligation to the Client. 8. Use of Trademarks The Client may use E-goi's name and trademarks (i.e., logos, mascots, and copyrighted images) according to the Identity Manual in the E-goi Press Kit. It may not alter or remove any proprietary notices on E-goi marks. It will not use E-goi's name or marks in the name or logo of its Integration, or in any manner that implies an endorsement by E-goi. If it uses E-goi's marks to create its logo or name, the Client will immediately cede these rights at no cost. 9. Observation To the maximum extent permitted by law, the APIs are provided "as-is". E-goi makes no warranties of any kind, express or implied, including, but not limited to, merchantability and fitness for a particular purpose. E-goi shall not be liable for any direct, indirect, incidental, consequential, or punitive damages resulting from the use of the APIs, including, but not limited to, data loss, income, profits, or business interruptions. This liability waiver shall not apply only if gross negligence or wilful misconduct on the part of E-goi is conclusively demonstrated. The Client is fully responsible for implementing and maintaining appropriate security measures to protect its API keys, systems, and data from unauthorised access, misuse, or other undesirable behaviour. E-goi will make all reasonable efforts to protect the Client against malicious behaviour related to the use of the APIs. However, any abuse, theft of API keys, or misuse of the Service resulting from security failures under the responsibility of the Client will be the sole responsibility of the Client. 10. Updates E-goi may update or modify the APIs and this Policy from time to time, publishing the latest version on the E-goi Site. E-goi will notify the Client via RSS about any changes to this Policy as soon as possible. The Client will have the opportunity, in case of objection, to terminate the Agreement within thirty (30) days after that notification. Unless the Client closes the Service, the new Policy will take effect immediately after the publication date indicated in the new Policy, as applicable, and will apply with the continuation or new use of the Service. 11. E-goi Integration Plugin Compatibility 11.1 Compatibility Guarantee E-goi commits to ensuring that its integration plugins are compatible solely and exclusively with the standard versions of the software with which they integrate, as distributed by the official publisher of the software, without alteration or customization of any nature. 11.2 Exclusions from the Guarantee E-goi does not guarantee the compatibility of E-goi integration plugins with software versions that have been modified, altered, expanded, or customized, whether through forks, third-party plugins, or any other form of non-official customization. The use of modified or customized versions of the software may affect the functionality of E-goi plugins, and is, therefore, the sole responsibility of the Client. 11.3 Limited Support for Modified Versions E-goi will provide technical support only for standard versions of the software with which E-goi integration plugins integrate. For modified or customized versions, E-goi may limit support or not provide it, as determined by E-goi's technical department. 12. Confidentiality The Client may have access to specific confidential, proprietary, and non-public information of the APIs. The Client may use this information only to develop for the API. The Client will not disclose the confidential information to anyone without E-goi's written consent, and will protect the confidential information against unauthorised use and disclosure in the same manner it would protect its own confidential information. 13. Indemnification The Client will indemnify and hold E-goi and its Employees harmless from any losses (including attorney's fees) resulting from third-party claims related to the Client's use of the API. 14. General Provisions This Policy does not create or infer any partnership, agency, or joint venture. This Policy will apply while the Client uses the APIs or until terminated in accordance with E-goi's Terms of Use. In the event of a conflict between this Policy and the Terms of Use (attached to this Agreement), the Terms of Use will prevail.
